Terms of Service

1. Acceptance of Terms

By accessing or using Omnismith ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Omnismith is a data management platform that allows you to create custom schemas, track entities, visualize metrics over time, and maintain audit histories. The Service is provided on a subscription basis with a free tier.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 16 years old to use the Service.

4. Your Data

You retain all rights to the data you store in Omnismith. We do not claim ownership of your content. You grant us a limited license to host, store, and process your data solely for the purpose of providing the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' data
• Interfere with or disrupt the Service's infrastructure
• Use the Service to store or transmit malicious code
• Exceed your plan's usage limits through automated circumvention
• Resell or redistribute the Service without authorization

6. Subscription & Billing

Paid plans are billed monthly through LemonSqueezy. You can upgrade, downgrade, or cancel at any time. Downgrades take effect at the end of your current billing period. Refunds are handled on a case-by-case basis.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice for planned maintenance.

8. API Usage

API access is included in all plans. Usage is subject to your plan's rate limits and ingestion quotas. We reserve the right to throttle or restrict API access that negatively impacts the Service for other users.

9. AI Assistant

The AI assistant is powered by Google Gemini. AI-generated responses are provided as-is and should be reviewed before acting on them. AI usage consumes credits from your plan allocation.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Termination

We may suspend or terminate your account for violation of these terms. Upon termination, you may request an export of your data within 30 days. After 30 days, your data will be permanently deleted.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify you of material changes via email.
